Terms and Conditions

Please note the following Terms and Conditions carefully, as they explain the nature and scope of the relationship between Nuvoco and a member of the program. The Terms and Conditions given below are intended to protect rights for both Nuvoco and you as a MILAN member. Every MILAN member is bound by these terms and Conditions.

Definitions:

For the purpose of the Terms and Conditions, the following terms shall have the meaning assigned to it hereunder:

 

  • 'Nuvoco' means Nuvoco Vistas Corp. Ltd.
  • MILAN means the Indirect Channel Loyalty and Rewards Program where the rewards, relationship and recognition initiatives are owned, managed and operated by Nuvoco, who will provide benefits, rewards and recognition to the enrolled members.
  • 'Member' means an Indirect Channel Partner who is admitted by Nuvoco into the loyalty program.
  • Dealer means an intermediary who purchases cement from Nuvoco for resale to Indirect Channel partners, customer, and builders.
  • 'Month' means a calendar month.
  • 'Benefits' means the rewards and facilities that are given to a member under the MILAN Loyalty and Rewards Program based on pre-defined criteria.
  • 'Rewards' are the gifts offered by Nuvoco, from time to time at its sole discretion, to members of the MILAN Loyalty and Rewards Program, against redemption of points earned by them.
  • 'Helpdesk or Helpline' means the service Centre for resolving MILAN Members' queries in connection with or related to MILAN Loyalty and Rewards Program only.
  • 'Retro-credit' means facilitating the credit of points to members based on booked purchases with retrospective effect as on the date of transaction.
  • 'Base Points' means the points earned by a Member of MILAN against Nuvoco Cement purchase by the member from Nuvoco active Maitree Dealer.
  • 'Member ID' means Unique MILAN code.
  • 'Service Partners' shall mean the implementation agency and other in-house or contract providers.
  • 'Program' shall mean the MILAN Loyalty and Rewards Program.
  • 'On-going program' means the program validity shall continue as long as it is not expressly terminated by Nuvoco. It is a long-term initiative by Nuvoco.
  • 'Active' means a business concern who does regular cement transaction from an active Maitree Dealer.
  • Active Maitree Dealer means a registered Nuvoco dealer who purchases cement from Nuvoco and admitted by Nuvoco as an active Maitree dealer.

 

Eligibility and Membership:

 

  • If the MILAN registration of the enrolled member /Maitree Dealer's code is terminated by Nuvoco for any reason whatsoever, Nuvoco's decision in this regard being final and conclusive. The Membership ID, or Member ID, will also be terminated.
  • In case a membership expires or is terminated, all unexpired points in the following redemption window will automatically lapse / expire.
  • Any personal details and data acquired from members' participation in MILAN Will be used only in accordance with the Nuvoco's Privacy Policy.
  • KYC Application for membership of the MILAN Loyalty and Rewards Program will be deemed that the applicant MILAN Member has read and understood the terms governing the program and has irrevocably undertaken to be bound by the same.
  • One MILAN member can be mapped to one active Maitree dealer only. These Terms of Use will be governed by and construed in accordance with the laws of India and the Courts in Kolkata shall have exclusive jurisdiction over any disputes arising out of the program or the Terms and Conditions thereof.

 

Rewards and benefits:

 

  • All Members who are enrolled into the MILAN Loyalty and Rewards Program by Nuvoco are entitled to earn points which can be redeemed for rewards that will be sent to the members in accordance with the Terms and Conditions specified.
  • All rewards-related communication will be mailed to the specific mailing address as provided in the KYC form.
  • Points issued in the MILAN Loyalty and Rewards Program have no monetary value and cannot be assigned, sold or transferred by members in any manner what so ever at any point of time or be redeemed for cash.
  • The points earned by members are valid till the members are active Sub- Dealers of Nuvoco. In case a membership expires or is terminated or in the event of termination of dealership for whatever reason, all points will lapse/expire. Nuvoco's decision in this regard will be final and conclusive.
  • No purchase/sale/transfer of points or benefits is permitted. The member can only earn points as per the conditions specified in this program.
  • The Delivery of MILAN Loyalty and Rewards Program items will be made only to the registered address of the MILAN Member as per the KYC form. At the time of delivery of the MILAN Rewards items the MILAN member or the authorized receiver of the item is compulsorily required to furnish any Proof of Identity (such as Driving License, Ration Card, Aadhaar Card, Voter Id Card, Pan Card, Electricity Bill, or Passport) to be eligible to receive them. Nuvoco / its Associates will bear no responsibility of the item, in case of any discrepancy /non production of the required proof of Identity.
  • No cash top-up or cash reimbursement for points or benefits will be given at any point of time.
  • All members will receive monthly SMS containing the points earned / acquired. They can also view /print their Loyalty and Rewards Point Statement from their MILAN account from the Website: www.minalrewards.co.in.
  • In case of death of a MILAN member, the benefits arising out of this program will not pass on to any other family member.
  • Selection of MILAN rewards and benefits is and will at the sole discretion of Nuvoco. Nuvoco may change without notice.
  • Nuvoco will not accept responsibility for any delays in delivery of rewards or benefits.
  • Nuvoco will not be responsible for rewards or benefits that are stolen, damaged or lost in transit before actual delivery to the member.
  • All rewards and benefits offered by Nuvoco are on a best-effort basis. In case a member is not offered a particular benefits or if Nuvoco does not make a particular reward or benefits available, Nuvoco will not be liable to compensate in any way.

 

General:

 

  • One MILAN Member can be mapped to one active Maitree dealer only.
  • The member has to compulsorily transact (sales registered under MILAN) in 9 out of the 12 months from the period April to March to be eligible for benefits under MILAN Loyalty and Rewards Program.
  • Qualified MILAN member must sign the MILAN KYC form as an acceptance of MILAN Loyalty and Rewards Program Terms and Conditions. The Program earnings will be tracked for all Qualified and solicited MILAN member. However all other benefits, privileges, redemption etc. can be availed only after the MILAN KYC form is signed and submitted by the MILAN member.
  • All Calculations for Reward points will be based solely on the transactions which are registered through MILAN loyalty Program.
  • Nuvoco reserves the right to withhold rewards and benefits at any time without assigning any reason what so ever and also may also terminate the membership of a member if such member breaches the Terms and conditions of this program. Upon such termination, all benefits standing to the credit of the member shall be lost without the member being entitled for any compensation therefore and the member shall be barred from future membership.
  • The program does not have any pre-determined date of termination and shall be in force until Nuvoco, at its sole discretion, terminates the program.
  • Nuvoco reserves the right to add, modify, delete or otherwise change the Terms and Conditions.
  • The program and any rewards or benefits there under, offering or the like relating to the program shall not constitute or deemed to constitute a contract.
  • Members shall be responsible for their own awareness and updating themselves with the program rules and their entitlements and eligibilities.
  • All communication and benefits shall be sent by mail or handed over to members at the address mentioned in the KYC form. Nuvoco and/or its service partners shall not liable for the failure of any communications to reach the members, it shall be the responsibility for the member to inform Nuvoco about any change in address and Nuvoco bears no responsibility for communication lost or not received.
  • All communication will be deemed to have been received by the member within 7days of dispatch of the communication. All communication by the member shall be deemed to have been received on actual receipt.
  • In the event of dispute in connection with the program and the interpretation of these Terms and Conditions, Nuvoco's decision shall be final and binding. The program shall be governed by the laws of India and all disputes will be subject to the exclusive jurisdiction of the courts in Kolkata.
  • The terms and conditions printed here in will be final and binding. Additionally, for all intents and purposes, the Terms and conditions in English will be final binding and will prevail over the Terms and Conditions in any other language.
